  Once an employee has violated a DOT rule by testing positive for either drugs or alcohol, or by refusing to test, the empolyer must immediately remove the employee from the safety sensitive position and refer the employee to a DOT Qualified Substance Abuse Professional.  The employee will then begin the return-to-duty process which begins with the initial, face to face, evaluation by the SAP.  Based on this assessment, the SAP will refer the employee to treatment or education depending on the severity of the alcohol and/or drug problem.  Once the employee completes the treatment or education they must return to the SAP for the follow up evaluation, at which point the SAP will determine if the employee has met the treatment plan goals.  If  the employee has met the treatment plan goals to the satisfaction of the SAP, the SAP will inform the employer that the employee has complied with the SAP's recommendations.  It is then the responsibility of the employer to decide if the employee is to return to safety sensitive duty. (This decision is not the SAP's.)  An aftercare plan and a follow up testing plan will accompany the follow up evaluation.  The employer is responsibel for seeing that the follow-up-testing plan is carried out.
